Advisory Opinion 24-01

​The opinion lists the criteria used by the Board in determining whether a legislator’s or legislative staff’s contract or grant with a state agency presents a conflict with their official duties.

There are specific criteria that would automatically prevent a legislator or legislative staff from entering into a contract or grant with a state agency. The remaining criteria listed are not in order of priority and will be examined by the Board. Other than the criteria that would specifically prevent a legislator or staff from entering into a contract or grant with a state agency, the Board reviews the totality of circumstances in determining whether there is a conflict.
