Advisory Opinion 26-01

The Board was asked whether, under RCW 42.52.175(2), a legislator could include in a newsletter to constituents, information about other governmental agencies.

Under RCW 42.52.175(2)(b), there is an automatic or per se legislative nexus if a member posts information originally published by another governmental agency which provides information about government resources. Because the legislature expanded in RCW 42.52.175(2) the items that are considered to have legislative nexus, the Board extends these per se items to include newsletters as well.
