Did Respondent in a post on his personal Facebook page, use his official position as a legislator when he created the impression that he had access to personal information about his constituent’s use of social welfare benefits?

Yes. Please see In re McEntire, 2026-No. 15 in which the Board found reasonable cause. Complaints 2026 – Nos. 12 & 13 are dismissed because the allegations in these complaints were the same as in 2026 – No. 15 in which the Board already found reasonable cause.
