Review of the Office of Privacy and Data Protection

The Legislature created the Office of Privacy and Data Protection to be Washington state's central point of contact for data privacy, data protection, and access equity  

The Office of Privacy and Data Protection (OPDP) is part of Washington Technology Solutions (WaTech). WaTech operates the state's technology infrastructure and provides strategic direction on technology issues.

In 2016, the Legislature established OPDP as the state's central point of contact for data privacy, data protection, and access equity (SHB 2875, Chapter 195, Laws of 2016). Access equity refers to efforts to ensure Washington residents obtain digital skills and have access to reliable internet, computers, and other devices.

The bill required that OPDP:

  • Review state agencies' privacy practices and coordinate with WaTech on data privacy and protection projects.
  • Provide training for state agencies and local governments and articulate privacy principles and best practices. 
  • Serve as a resource to local governments and the public on data privacy and protection issues.
  • Report on broadband access, if possible within existing resources.
  • Measure and report on its performance, including its statutory training, education, and data privacy coordination efforts.

Study scope

JLARC must conduct a program and fiscal review of OPDP.

This study will address the following questions

Study questions reflect preliminary outreach, research, and analysis of potential racial equity considerations per RCW 44.28.076.

  1. To what extent do OPDP's activities align with legislative intent?
  2. How does OPDP measure its performance? How do its measures align with statutory requirements?
  3. To what extent do OPDP's activities overlap with those of other entities?
  4. What is OPDP doing to ensure equitable access to its resources for state agencies, local governments, and the public?
